ဥပေဒသေဘာအရ ထံုးတမ္းဥပေဒမွာ မယားျပိဳင္စနစ္ကို ဘယ္လုိဘဲ ခြင့္ျပဳ ခြင့္ျပဳ၊ တစ္လင္တစ္မယား အထူးဥပေဒက လႊမ္းမုိးသြားပါတယ္။ တစ္နည္းအားျဖင့္ ထံုးတမ္းဥပေဒမွာ မယားျပိဳင္ကို လက္ထက္ပြားအက်ိဳး ခံစားခြင့္၊ ေမြးလာတဲ့ကေလးကို အေမြဆက္ခံခြင့္ ေပးေပမယ့္ အထူးဥပေဒက မယားျပိဳင္ကို တရားမ၀င္လုိ႕ သတ္မွတ္တဲ့အတြက္ ေနာက္မယားနဲ႕ သူ႕ကေလးေတြဟာ ပစၥည္းခြဲေ၀ခြင့္ႏွင့္ အေမြဆက္ခံခြင့္ ဆံုးရႈံံးမွာ ျဖစ္ပါတယ္။

အျပင္မွာ တစ္ညေလး သြားအိပ္မိပါတယ္။ ဥပေဒအတားအဆီးေတြက တစ္ပံုၾကီးျဖစ္ေနတယ္။ အိပ္ေနတုန္း ဖမ္းမိတာနဲ႕ အခ်ဳပ္နဲ႕ ေနရေတာ့မယ္။ အာမခံမရေတာ့ဘူး။ ရဲအေရးပုိင္တဲ့အမႈ ျဖစ္တဲ့အတြက္ ျပစ္မႈ က်င့္ထံုးဥပေဒပုဒ္မ-၁၅၄ အရ မည္သူမဆို တိုင္တန္းလုိ႕ ရတယ္။ ျပင္ပသူစိမ္းတစ္ေယာက္က လူတစ္ဦး အျပင္မွာ အျခားတစ္ေယာက္နဲ႕ အိပ္တာကို မွတ္တမ္းယူျပီး ျခိမ္းေျခာက္မႈေတြ ျပဳလုပ္လာႏိုင္ပါတယ္။ ဥပေဒအသစ္ဟာ ကုိယ့္မိသားစုအေရးကို သူစိမ္းကို စြက္ဖက္ခြင့္ ေပးရာေရာက္ေနပါတယ္။

ရဲကုိယ္တုိင္က ဒါမွမဟုတ္ ရဲက လက္ေထာက္ခ်တဲ့ သူစိမ္းတစ္ေယာက္က ဒါမွမဟုတ္ အတြင္းသိ အစင္းသိ သူစိမ္းတစ္ေယာက္က အျပင္မွာ မိန္းမတစ္ေယာက္နဲ႕ အိပ္တဲ့ေယာက်ာ္းကို ျခိမ္းေျခာက္လာႏိုင္ ပါတယ္။ ဘာေၾကာင့္လဲဆုိေတာ့ ရဲအေရးပုိင္တဲ့အမႈျဖစ္ေနလုိ႕ မည္သူမဆုိ တုိင္တန္းခြင့္ ရွိေနလို႕ပါဘဲ။ ရဲစခန္းမွာ အမႈသြားဖြင့္လုိက္ရံုပါဘဲ။ ရဲကလည္း အမႈဖြင့္လွစ္ခြင့္ ရွိေနပါတယ္။ ျပစ္မႈက်င့္ထံုးဥပေဒပုဒ္မ-၁၅၄ အရ ရဲအေရးပိုင္တဲ့အမႈကုိ ျပစ္မႈက်ဴးလြန္ေၾကာင္း သိရွိသူ မည္သူမဆုိ အမႈဖြင့္လွစ္ခြင့္ ရွိေနလုိ႕ပါဘဲ။

အထူးဥပေဒအရ ေထာင္ဒဏ္(၃)ႏွစ္ေအာက္ ျဖစ္မယ္ဆုိရင္ ျပစ္မႈက်င့္ထံုးဥပေဒ ေနာက္ဆက္တဲြ ဇယား(၂) အရ ၀ရမ္းမပါဘဲ ဖမ္းဆီးခြင့္ မရွိပါဘူး။ အာမခံ ရရွိမွာ ျဖစ္ပါတယ္။ ၀ရမ္းမပါဘဲ ဖမ္းဆီးခြင့္ မရွိဘူး ဆုိရင္ ရဲအေရးမပိုင္ေတာ့ပါဘူး။ ရဲအေရးမပုိင္ေတာ့ဘူးဆုိရင္ ရဲစခန္းမွာ ေတြ႕ကရာလူက အမႈသြားေရာက္ ဖြင့္လွစ္ခြင့္ မရွိေတာ့ပါဘူး။ ရဲအေရးမပိုင္တဲ့အမႈကုိ တရားရံုးမွာ ဦးတုိက္ေလွ်ာက္ထားရမွာ ျဖစ္ပါတယ္။ ရဲအေရး ပုိင္တဲ့အမႈမွာလုိ အမႈတုိင္ၾကားရံုႏွင့္ တရားရံုးေရွ႕ သက္ေသထြက္ရံုေလာက္ဘဲ တာ၀န္ရွိမွာ မဟုတ္ေတာ့ပါဘူး။ ရဲအေရးပုိင္တဲ့အမႈမွာလုိ ရဲက သက္ေသေတြကို စစ္ေဆးတင္ျပတာမ်ိဳးလုပ္မွာ မဟုတ္ေတာ့ပါဘူး။ ဦးတုိက္ ေလွ်ာက္ထားရတဲ့အမႈျဖစ္တဲ့အတြက္ ျပစ္မႈက်ဴးလြန္တာကို မည္သူမဆုိ တုိင္ၾကားခြင့္ ရွိသည့္တုိင္ေအာင္ ကိုယ္တင္ျပလိုတဲ့ သက္ေသေတြကို ကုိယ္ကုိယ္တုိင္ တင္ျပရမွာ ျဖစ္ပါတယ္။ ဦးတိုက္ေလွ်ာက္ထားမႈ ျဖစ္တဲ့ အတြက္ ဦးတုိက္တုိင္တန္းသူဟာ စြဲခ်က္မတင္မခ်င္း တရားရံုးတက္ေရာက္ရပါလိမ့္မယ္။
ေထာင္ဒဏ္ကို (၃)ႏွစ္ေအာက္ ျပ႒ာန္းလုိက္မယ္ဆုိရင္ ရဲအေရးမပိုင္တဲ့အမႈျဖစ္တဲ့အတြက္၊ ဦးတုိက္ ေလွ်ာက္ထားရေတာ့မွာ ျဖစ္တဲ့အတြက္၊ ဦးတုိက္ေလွ်ာက္ထားသူကုိယ္တုိင္ စြဲခ်က္မတင္မခ်င္း ရံုးတက္ေရာက္ ရမွာ ျဖစ္တဲ့အတြက္ လူတစ္ဦးတစ္ေယာက္ကို အလြယ္တကူ စြပ္စြဲမႈေတြ မျဖစ္ေပၚေစႏိုင္ေတာ့ပါဘူး။ ကာမပိုင္ျဖစ္သူ လက္ရွိမယားကုိယ္တုိင္က မေက်နပ္လုိ႕ တရားစြဲဆုိတာမ်ိဳး ျဖစ္မွသာ ပိုမိုသဘာ၀က်မည္ ျဖစ္ပါတယ္။ ေယာက်ာ္းတစ္ေယာက္ အျပင္မွာအိပ္တာကို ကာမပိုင္ မိန္းမ မဟုတ္တဲ့ သူစိမ္းတစ္ေယာက္က တရားစြဲဆုိခြင့္ ရွိေအာင္ ေထာင္ဒဏ္(၇)ႏွစ္ ျပ႒ာန္းထားျခင္းျဖင့္ ရဲအေရးပိုင္မႈ ျဖစ္ေနေစသည္မွာ တရားမွ်တမႈ မရွိပါ။
(၇) ဥပေဒ လက္တစ္လံုးျခား ကိစၥရပ္မ်ား
